5. Client Data Processing and AI Services

  • Only process Client Data in accordance with your instructions and our service agreement
  • Not use Client Data to train AI models for other clients without your explicit written consent
  • Implement appropriate technical and organizational safeguards for all data in our possession
  • Delete or return Client Data upon termination of services, unless retention is required by law
  • Disclose which third-party AI tools and platforms are used in the delivery of your services upon request
  • Ensure that any third-party AI platform used is bound by data processing agreements with appropriate confidentiality and security obligations

Data Controller vs. Processor: When we process Client Data on your behalf and under your instructions, we act as a data processor. For personal information we collect independently (e.g., your contact details for our business relationship), we act as a data controller. Our respective roles will be documented in the applicable service agreement or Data Processing Addendum where required.

6. Data Sharing and Disclosure

We do not sell, rent, or trade your personal information. We may share information with:

  • Service Providers: Third-party vendors who assist in delivering our services (cloud hosting, AI platforms, payment processors), bound by written data processing agreements with confidentiality and security obligations
  • Legal Requirements: When required by law, regulation, legal process, or governmental request
  • Business Transfers: In connection with a merger, acquisition, or sale of assets, with prior notice to affected clients where practicable
  • With Your Consent: When you have given us explicit permission to share specific information

7. International Data Transfers

In the course of providing AI consulting services, your data may be transferred to and processed in countries other than your own, including the United States. This may occur when we use third-party AI platforms, cloud infrastructure, or other service providers that operate internationally. Where such transfers occur, we take steps to ensure that appropriate safeguards are in place, which may include Standard Contractual Clauses (SCCs), reliance on adequacy decisions, or other lawful transfer mechanisms as required by applicable data protection laws.

8. Data Security

We implement commercially reasonable administrative, technical, and physical safeguards to protect your information. These include encryption in transit and at rest, access controls, secure development practices, and regular security reviews. However, no method of transmission or storage is 100% secure, and we cannot guarantee absolute security.

9. Data Breach Notification

In the event of a data breach affecting your personal information or Client Data, we will notify you without undue delay and in accordance with applicable law. Where we act as a data processor on your behalf, we will notify you within forty-eight (48) hours of becoming aware of a breach to enable you to meet your own regulatory notification obligations. Notification will include, to the extent known, the nature of the breach, the categories and approximate number of records affected, the likely consequences, and the measures taken or proposed to address the breach.

10. Data Retention

We retain personal information for as long as necessary to fulfill the purposes described in this policy, comply with legal obligations, resolve disputes, and enforce our agreements. Specific retention periods are as follows:

  • Client contact and billing information: For the duration of the business relationship plus seven (7) years for tax and accounting purposes
  • Client Data provided for AI processing: Retained only for the duration specified in the applicable service agreement, then deleted or returned within thirty (30) days of project completion or termination
  • Website usage data: Up to twenty-four (24) months
  • Marketing communications records: Until you unsubscribe, plus records of consent retained for three (3) years

11. Your Rights and Choices

Depending on your jurisdiction, you may have the right to:

  • Access, correct, or delete your personal information
  • Object to or restrict certain processing activities
  • Request portability of your data in a structured, machine-readable format
  • Withdraw consent where processing is based on consent, without affecting the lawfulness of processing prior to withdrawal
  • Opt out of marketing communications at any time
  • Opt out of the sale or sharing of personal information (note: we do not sell personal information)
  • Lodge a complaint with a supervisory authority in your jurisdiction
